10. Summary of thesis conclusion:
Firstly, the thesis has contributed to clarifying the perception of Ho Chi Minh's constitutional thought; analyzing the content of his constitutional thought in our country's Constitutions in the historical periods of the country; Achievements in constitutional work in our country through the periods of the country's development; Limitations of and causes as well as conditions limiting constitutional work; Proposing solutions to improve the quality of constitutional work in the current Socialist Rule of Law State in Vietnam.
Second, the thesis has generalized Ho Chi Minh's constitutional thought in the constitutional work that our people, together with the Party and the State, have achieved through the historical stages of the country through the construction and development of the Constitution, which are: (1) The first Constitution of the Democratic Republic of Vietnam was built by our people in 1946, consisting of a preamble and 70 articles stipulated in 7 chapters. The basic principles of the Constitution in the preamble are expressed: National unity regardless of race, gender, class, religion; ensuring democratic freedom and government of the people, by the people and for the people; (2) The stage of the Vietnamese Revolution moving to a new form. The new Constitution (1959) is a truly democratic Constitution. The 1975 Spring General Offensive and Uprising was a decisive and great strategic battle of our army and people, with the historic and victorious Ho Chi Minh campaign ending the 21-year resistance war against the American imperialists of the Vietnamese people, and the country was reunited. The conference decided to unify the state by a general election to elect a common National Assembly for the whole country. On July 2, 1976, the 6th National Assembly of the Democratic Republic of Vietnam decided to change the country's name to the Socialist Republic of Vietnam. (3) That was the Constitution of the transitional period to socialism throughout the country. For the first time, the concept of "People's ownership" of land was introduced into the Constitution. In terms of form, the 1980 Constitution was based on the model of the 1977 Constitution of the Soviet Union with the mechanism of the National Assembly electing the State Council. (4) In the period of renovation since 1986, the comprehensive renovation of the country initiated by the 6th Congress of the Communist Party of Vietnam has achieved very important initial achievements. In terms of structure, the 1992 Constitution abolished the State Council and assigned the position to an individual, the President. The 10th National Assembly has the responsibility to continue institutionalizing the Party's platform and strategy. (5) Compared to previous Constitutions, the 2013 Constitution is a Constitution with many new, progressive contents, deeply humane, and is the crystallization of the wisdom and theoretical and legal achievements of our Party and State after more than 30 years of renovation. However, many progressive contents of the Constitution have not been specified or need to be supplemented for completion, such as: State power control mechanism; Establishment of the Constitutional Protection Agency and the Constitutional Protection Mechanism; development of specific procedures and processes for handling violations of the Constitution; Perfecting the Constitution and legal system of a rule of law state.
Third, the thesis analyzed the contents of Ho Chi Minh's constitutional thought and proposed a number of solutions to improve the effectiveness of constitutional work in the new development stage of the country, namely (1) Establishing a Constitutional Protection Agency and a Constitutional Protection Mechanism, (2) Building specific procedural procedures for resolving violations of the Constitution, (3) Strengthening the mechanism for controlling state power, (4) Strengthening the completion of the Constitution and the legal system of the rule of law State, (5) Strengthening people's participation in the management of state activities.
