Trademarks and trade names are both important tools for businesses to reach customers. Although the functions of trademarks and trade names are different, for small and medium enterprises, they use these two concepts with similar meanings. With different principles of establishing rights, specifically, rights to trademarks are established on the basis of registration while rights to trade names are established on the basis of use, the scope of rights of these two subjects is different, but in reality, there are similar ways of using them, leading to conflicts of rights between these two subjects, making it difficult for both owners and competent state agencies to enforce the rights. Registered trademarks of enterprises have related data stored centrally at a single point, the Department of Intellectual Property. As for registered and licensed trade names, data is stored at the Department of Planning and Investment of the province/city and in the national business registration database. Therefore, to manage trademarks and trade names, it is necessary to develop a policy to link scientific and technological information between the Ministry of Science and Technology and the Ministry of Planning and Investment, to avoid overlapping or similar trade names and trademarks.
